Please read them carefully since your review of the information displayed at the site, the use of the services it offers, and the purchase of products through the site, confirm your consent to these terms.

These regulations refer equally to men and women and are phrased in masculine for phrasing purposes only.

Magnipic maintains the right to modify the regulations from time to time. For an updated version of the regulations please review the company regulations as they are published in Magnipic.co.uk. The version published in the web site is always valid. These regulations were updated on 15.11.06.

General

It is strictly forbidden to use the site or its provided editing tools for editing and/or uploading of texts and images which are: protected by copyrights while the user have not obtained the appropriate permits, constituting any evidence for or indicating any criminal/civil offence, forming any defamation or slander, including any profane or pornographic materials, expressing any racist opinions and or breaching the right of privacy, trademark rights or any other material constituting a cause for claim or violating any law, including the act against defamation.

Any person providing the site's operators with any materials for print productions is in doing so confirming his ownership of any copyrights in respect of the provided materials, or his lawful permit to use them. Any person violating this order authorizes Magnipic to assign him with any claim, once such claim is filed, and to have no responsibility in this respect.

Magnipic cannot monitor all the materials uploaded to the site and/or sent for print, yet we preserve the right to delete improper materials from the company computers and/or to act in any way as we may see fit according to any such committed violation.

Magnipic will bear no responsibility for any damage that might result from any such cases. Magnipic preserves full rights to claim compensations and/or indemnifications for any damage or legal procedure caused to it and/or its operators and/or its managers and/or its employees and/or any of its udders and/or any third party whatsoever, following any such actions as specified above.

It is hereby asserted that any storage of materials by the site for its customers will not be regarded in any case as transfer of the possession of the material to the hands of Magnipic. The site may only sell products to customers who were fully identified in the provided purchase form, and who hold a valid email address.

Children who are not in the possession of a credit card may register via an adult who holds the card and who will register as the holder of the account in their name.

Please note, submission of false data is a criminal offense. Magnipic preserves the right to deny access to the site and cancel the registration of purchasers whose conduct is not in accordance with the regulations and/or who attempt to interfere with their proper processing.

Electronic communication

 Any agreement, message, or any other form of communication between the site and the user via email will be seen legally as if it was done in writing. Information and contents in the site Magnipic.co.uk publishes various contents which are provided by the site or by other affiliated companies or sites (Hereinafter: Content Providers). Magnipic and the content providers bear no responsibility for the contents of the information or for any consequence resulting from the use of the information provided via the site. The use of the content produced by the user is solely the user's responsibility.

Magnipic responsibility

 The services and the information in Magnipic.co.uk are usable as is and cannot be customized to any specific personal needs. You will have no claim, appeal or request against Magnipic and/or the content providers with respect to characteristics of the services, their abilities, limitations, suitability to your needs or the reactions they provoke (if any). The use of the services and the purchase of products will be done under your soul and full responsibility.

Magnipic and the content providers are not responsible for any damages that may be caused to the user or his property as a result of the use of a picture produced by the site. Magnipic cannot guarantee that the site's services will not be interfered, issued orderly with no interferences, provided safely with no mistakes, and be fully protected against unauthorized access to Magnipic computers or against damages, spoilage, malfunctions or failures – and all in terms of hardware, software, communication lines, at Magnipic or at any of its providers.

With no affect to the aforesaid, Magnipic and its provided will not bear any responsibility and will not be charged with respect to any claim, request and complaint raised against them by any of the site's users and/or any third party due to any claim whatsoever which is related with and/or involves the use of the and the services and products included in the site.

With no affect to the aforesaid, Magnipic and the content providers will not bear any responsibility for any damage either direct or indirect, specific or consequential, including loss of incomes or profits, which will be caused, if it is to be caused, to the users of the site and/or any other third party due to the use of the site's services, the information it lists and the products it offers, even while Magnipic and/or its providers learn about the feasibility of any such damages.

The site's users hereby confirm that their use of the site constitutes their agreement to compensate and indemnify Magnipic and/or its providers or business partners, immediately upon their initial request, for any sum and/or expense and/or money demand and/or debt of any sort which Magnipic and/or its providers and or its business partners may be requested to pay to any party with respect to any claim and notice by a third party submitted to Magnipic and/or its providers or business partners due to their use of the site and its included information in violation of its terms of use.

Material storage

 Magnipic acts reasonably and with every mean in its disposal to maintain the integrity of the materials transferred to it for print. Yet, the user must make sure to backup the material sent to the site just in case.

Magnipic is not responsible for the recovery of any damaged/deleted files which were in its possession and the user may not be entitled for any compensation from the site in case such an event takes place. In case any material is lost before it was produced, in such a way that its recovery is impossible, the customer will be fully refunded for what he'd paid. The site does not promise to maintain the materials sent to it after providing the requested product, therefore we recommend to keep a backup in the PC.

In any case the Magnipic will not compensate you for any damage and/or claim and/or loss of information and/or loss of profit, whether direct or indirect, of any sort or kind.

Service change and termination

Magnipic preserves the right to terminate these services, in whole or in part, at any given moment. Magnipic may change from time to time the structure of the site providing these services, its appearance, the scope and availability of its provided services and any other related aspect – and all without the need for advanced notice. Such changes will take place, inter alia, considering the dynamic nature of the internet and any other related technical changes.

By their nature, such changes may involve malfunctions and/or cause difficulties due to the implementation of any such changes and/or failures occurring due their implementation.

Privacy

Magnipic may use the data it provides through the site and the information it gathers concerning the site use patterns – to improve its provided services, to contact you when needed or to analyze and provide statistics. Magnipic may, from time to time, send you commercial information via email.

Yet, Magnipic will not provide your personal details to advertisers, unless you specifically permit that in your application form.

Order, supply and cancelations

Product order and the message notifying "Image order successfully completed" does not constitute any confirmation by the company of the order reception and processing. Only after the file is obtained and technically inspected and the credit card is successfully charged will the order be sent to production and notified as accepted via email. All the delivery schedules published in the site will be set from the order transfer time after the file integrity is tested and the credit card is charged.

In some cases, during the order process the customer will be offered to click a code which was provided beforehand, and which grants him with a discount. After the code is fed the final sum of order after discount is displayed. To remove all doubt, the distributed codes are for one-time use unless specified otherwise. The presented bill will come into force upon the order's registration at the site and after the code is verified against the company's central database. In case the code was used in the past, the order will not be charged and a customer-service representative will contact the customer for further assistance.

The products purchased through the site will be supplied by a delivery operator. The risk of loss of items after their delivery to the dispatcher is under the responsibility of the dispatcher and not under the responsibility of Magnipic Ltd. Magnipic bears no responsibility for any delay in the delivery of the product due to force majeure or any events beyond the control of the company, including, but not only, strikes and sanctions. The delivery rates are in UK only. The rates for overseas delivery will be set by the site's customer service function.

Magnipic will bear no responsibility for any loss of shipment due to errors in the mailing address. Upon the delivery of the product the site may request the presence of the card holder for his identification and signature on the credit slip.

Transaction cancelations will be processed according to the directives of the Consumer Protection Act. (Hereinafter: The Consumer Protection act). Note, transactions involving customized products cannot be canceled. Requests for cancelation will be submitted in writing according to the details specified in the site.

Magnipic will accept cancelation of orders which production process was not initiated. Magnipic puts all its products through a strict quality assurance process conducted by expert specialists. In case you receive a product which might be defected, you must contact our customer service via email. A defected product will be fully refunded. In no case will the refund exceed the original price of the product.

Bear in mind that deviations of up to 15% in shade and up to 3% in measurement between the product as it appears on your PC and the final product are not considered as a defected product and are the result of color and size differences between the PC screen and actual printout.

Spiritual assets

All copyrights and spiritual assets related with the design of the site, any software, application, computer code, graphic file, text and any other material included in the site – are the exclusive property of Magnipic or one or more of its providers or business partners. It is strictly forbidden to modify, copy, distribute and publically display or transfer to a third party any of the aforesaid without an advanced written consent from Magnipic. Opinion, comments questions and suggestions Guests at the site may send their opinion, comments, questions, suggestions, ideas or any other material via email to info@magnipic.co.uk. Sending the material confirms that Magnipic may use this material as it may find fit.

Law and jurisdiction

 The use of the site is subject exclusively to the Israeli law. Any case involving this agreement or the site may be brought only before an authorized court in the Tel Aviv district.
